Terms and Conditions of Sale

These Terms and Conditions govern your use of the normedica.co.uk website. Northumbrian Medical Supplies Ltd sells its products to you subject to the conditions set out on this page.

Please read the conditions carefully as they affect your rights and liabilities under the law. By using the normedica.co.uk website, you signify your agreement to be bound by these conditions.

All goods are intended for sale in the United Kingdom and consequently no responsibility is accepted for non-compliance with local stability requirements and regulations in force elsewhere.

Order Acceptance

Orders placed by you are an offer to purchase and will be accepted by us, subject to these conditions of sale.
Orders are only binding upon receipt of written confirmation from Northumbrian Medical Supplies Ltd.

Unfortunately for reasons beyond our control items may become unavailable from the manufacturers and in these circumstances it may be impossible for us to fulfil an order. If this occurs we will do our utmost to inform you and the earliest opportunity.

 

We reserve the right to refuse any order without providing a reason, and to treat items ordered as separate orders.

Prices

All prices on the website are in GB £ and are subject to VAT, where applicable, which will be calculated upon checkout. Prices do not include delivery costs, again these will be calculated upon checkout but are subject to change dependant on the weight of the order. We will contact you prior to releasing the order if this is the case.

Every effort will be made to ensure that no errors are made in the prices displayed on the website, however if such an error should occur we reserve the right to cancel the order, provided it has not yet been dispatched.

Please be aware that we reserve the right to change prices without notice.

The website is not live and for those items that are not core stock, the prices may be subject to change dependant on the manufacturer. You will be notified prior to us processing your order if this is the case.

 

Payment

For registered account holders, payment is strictly 30 days after the date of invoice unless otherwise stipulated.

For all other customers, payment must be made upon checkout through the Opayo secure payment system which processes credit and debit card transactions.

Delivery

We will endeavour to deliver all in-stock items within two working days of receiving your order.
If items are out of stock at the time your order is placed we will notify you by telephone or email of any delay.
You may choose to cancel an out of stock order if you are unable or unwilling to wait for us to supply it to you.

Delivery will be made to the address specified on the order. All arrangements necessary to take delivery must be undertaken by the customer.

Northumbrian Medical Supplies Ltd will not be liable for any losses, costs, damages or expenses incurred arising out of any failure to meet any estimated delivery date.

Receipt of Goods

All deliveries must be signed for at the time of receipt.

It is the responsibility of the customer to ensure that the goods delivered are as stated on the accompanying delivery note.
A refund will only be considered provided any breakages or shortages have been reported to Northumbrian Medical Supplies Ltd within 3 working days of the delivery.

Non Delivery

In the event that you do not receive a delivery from Northumbrian Medical Supplies within 5 days of placing an order (and provided you have not been informed that the goods are out-of-stock) please inform us by telephone on 0191 2867799 as soon as possible.

Cancellation of Order

Once an order has been processed, any request by the customer to cancel the order shall be at the discretion of Northumbrian Medical Supplies Ltd.
A charge may be levied if such a cancellation is effected.

Northumbrian Medical Supplies Ltd reserves the right to cancel or amend any order after it has been accepted without penalty.

Retention of Title

All goods supplied by Northumbrian Medical Supplies Ltd to the customer shall remain the property of Northumbrian Medical Supplies Ltd until such time as Northumbrian Medical Supplies Ltd receives payment in full for the goods.

After delivery of the goods to the customer or his nominated sub-purchaser, the goods are at the customer’s risk and the customer must insure those goods against loss or damage.
Until such full payment is received the separate identity of those goods as Northumbrian Medical Supplies property shall be maintained by the customer.

Until such time as title in the goods shall pass to the customer in accordance with the foregoing provision, Northumbrian Medical Supplies Ltd are entitled at any time to repossess the goods and Northumbrian Medical Supplies and its employees or agents shall have the right at any time to enter the premises of the customer for the purpose of effecting such repossession.

Storage

The Buyers attention is drawn to the requirement for controlled storage conditions specified in connection with certain products. No claims shall be considered for loss or damage resulting from incorrect storage of the goods in any circumstances.

Licenses

The customer shall, at its expense, obtain any licence or consent necessary for the acquisition, use or sale of the goods and shall indemnify Northumbrian Medical Supplies against any expenses resulting from the customers failure to do so.

Force Majeure

Should delivery of any goods be prevented, hindered, delayed or rendered uneconomic by an act beyond Northumbrian Medical Supplies control, Northumbrian Medical Supplies Ltd may without liability to the customer suspend or terminate the contract.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the law of England and the customer hereby submits to the exclusive jurisdiction of the English courts.
